AND CONDITIONS
Terms & Conditions
1. General Requirements & Medical Safety
-
All participants must be at least 10 years old (or meet specific PADI age requirements for junior programs).
-
Medical Fitness: Participants must complete the PADI Medical Questionnaire. If a "Yes" is flagged, a physician’s signed clearance is mandatory. Dream Team Divers reserves the right to refuse diving if a participant appears physically unfit or under the influence.
-
Medical Rejection: If a participant is unable to dive due to a pre-existing medical condition not disclosed at the time of booking, our standard cancellation policy (Section 7) applies.
-
Flying After Diving: It is the diver's responsibility to ensure a minimum of 18–24 hours (per PADI/DAN guidelines) between their last dive and their flight. Dream Team Divers is not liable for missed flights or DCS resulting from a guest’s travel schedule.
2. Certification & Experience
-
Certified divers must present a valid physical or e-Card before the boat departs.
-
Refresher Policy: A Scuba Review/Refresher is mandatory if the last dive was >12 months ago. If a diver fails to disclose their "out of water" time and cannot safely perform skills in the water, the Instructor may terminate the dive for safety without a refund.
3. PADI Courses & Training
-
Certification is Earned: Payment for a course covers training and materials, but does not guarantee certification. Students must meet all PADI performance requirements to be certified.
-
Incomplete Courses: If a student chooses to discontinue a course or fails to meet performance requirements, no refund will be issued for the portions already started. A referral form will be provided for credit of completed sections.
4. Liability & Waiver
-
All divers must sign the PADI Release of Liability/Assumption of Risk/Non-Agency Acknowledgement Form.
-
Dream Team Divers and its staff act as intermediaries for boat operators and transport providers. We are not responsible for injuries, accidents, or property loss resulting from third-party negligence or "Acts of God."
5. Scheduling & Punctuality
-
The Boat Waits for No One: Departure times are strict. If a participant arrives late and misses the boat/transport, it is considered a "No Show" and no refund will be issued.
6. Weather and Conditions
-
Dive trips may be changed or canceled due to weather, sea conditions, or Navy/Park authority restrictions.
-
In the event of a cancellation by Dream Team Divers, a full refund or a reschedule will be offered.
7. Payments, Cancellations & Refunds
-
Full payment is required to secure a booking.
-
48+ Hours Notice: Full refund (minus any non-refundable credit card/transaction fees).
-
Less than 48 Hours Notice: 50% refund.
-
Same-day cancellation / No-show: No refund.
-
In-water refusal: No refunds are given for "cold feet," inability to equalize, or seasickness once the activity has commenced.
8. Equipment and Damages
-
Rental gear is checked before the trip. Any equipment damaged, lost, or dropped overboard due to negligence (e.g., leaving a computer on the dive deck) will be charged at the current Thai retail replacement value.
9. Underwater Photography Policy (Thai Law 2025)
-
In accordance with Thai law (effective April 23, 2025), camera use is restricted to:
-
Advanced Open Water certification or higher.
-
Minimum 40 logged dives.
-
-
Instructor Discretion: Regardless of certification, the Instructor has the final authority to prohibit camera use if they believe it endangers the diver, others, or the reef.
10. Photography and Media Use
-
Dream Team Divers reserves the right to use photos/videos taken during the trip for marketing. To opt-out, please notify us in writing via email/WhatsApp before the trip begins.
11. International Trips (e.g., Bali)
-
For trips outside of Thailand, participants are required to have valid travel insurance and specific Dive Injury Insurance (e.g., DAN). Local laws of the destination country will apply in addition to these terms.
12. Legal Jurisdiction
-
These terms are governed by the laws of the Kingdom of Thailand. Any legal disputes shall be settled in the courts of Chonburi, Thailand.
